Terms and Conditions

Welcome to BarberClock. These Terms and Conditions ("Terms") govern your use of the BarberClock mobile application and website (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Definitions
- "Platform" refers to the BarberClock mobile application (iOS and Android) and associated website at barberclock.com.
- "Client" refers to any user who books barber services through the Platform.
- "Barber" refers to any service provider who offers barbering services through the Platform.
- "Shop" refers to a barbershop created and managed by a head barber on the Platform.
- "Booking" refers to any appointment scheduled through the Platform.
- "Deposit" refers to the non-refundable payment required to confirm a booking.
2. Account Registration
To use the Platform, you must create an account by providing accurate and complete information including your name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to create an account as a Barber. Clients under 18 may use the Platform with parental or guardian consent.
3. Booking and Scheduling
- Clients may browse available barbers, view their profiles, services, pricing, and reviews before booking an appointment.
- Bookings are subject to barber availability and confirmation.
- Clients may request specific styles or preferences when making a booking. Barbers will make reasonable efforts to accommodate such requests.
- Bookings may be made with a specific barber or, where a barber operates within a Shop, with any available barber at that Shop.
- In-home service bookings are subject to additional terms set by the individual barber, including travel fees and service area restrictions.
4. Deposits and Payments
- A $25.00 non-refundable deposit is required to confirm most bookings, unless otherwise stated (e.g., subscription holders or promotional bookings).
- Deposits are processed securely through Stripe, our third-party payment processor.
- The deposit is applied toward the total service cost. The remaining balance is settled directly between the Client and Barber at the time of service.
- Deposits are non-refundable except in cases of emergency cancellation initiated by the Barber, in which case the Client may be offered a reschedule or refund at the Barber's discretion.
- Subscription holders may be exempt from deposit requirements as determined by their subscription plan.
5. Cancellation Policy
- Client Cancellation: Clients may cancel a booking at any time prior to the appointment. Deposits are non-refundable regardless of cancellation timing.
- Barber Cancellation: Barbers may cancel bookings in emergency situations. In such cases, Clients will be offered the option to reschedule or receive a deposit refund.
- No-Shows: If a Client fails to appear for a confirmed booking without prior cancellation, the deposit is forfeited and the Barber may mark the booking as a no-show.
6. Pricing and Fees
- Service prices are set by individual Barbers and displayed on their profiles.
- Prices may include applicable sales tax calculated based on the service location.
- Barbers may apply last-minute booking markups for appointments booked within a short time window.
- Discount codes may be offered by Barbers and are subject to terms set by the issuing Barber, including expiration dates and usage limits.
- Group booking pricing and policies are determined by the individual Barber.
7. Shops and Chair Fees
- Barbers may create or join a Shop on the Platform. The Shop creator serves as the head barber and administrator.
- Head barbers may set a chair fee (fixed or percentage-based) that is deducted from each booking payment processed through the Shop.
- Chair fees are distributed automatically through Stripe payment processing.
- Shop membership and chair fee terms are agreed upon between the head barber and member barbers. BarberClock facilitates but does not mediate disputes between Shop members.
8. Subscriptions
- Barbers may offer monthly subscription plans for unlimited services at a fixed rate.
- Subscription terms, including pricing and included services, are determined by the individual Barber.
- Subscriptions renew automatically each month unless cancelled by the Client or Barber.
- Cancellation of a subscription takes effect at the end of the current billing period.
9. Reviews and Ratings
- Clients may leave a review and rating (1-5 stars) after a completed booking.
- Reviews must be honest, relevant, and based on the actual service experience.
- BarberClock reserves the right to remove reviews that are fraudulent, abusive, discriminatory, or otherwise violate these Terms.
- Barbers may not solicit or incentivize reviews in exchange for discounts or other compensation.
10. Proof of Service
- Barbers may be required to upload before and after photos as proof of completed service.
- Photos are timestamped immutably to ensure accuracy and integrity.
- By uploading photos, Barbers confirm they have obtained verbal consent from the Client for the photographs.
- Photos may be displayed in the Barber's gallery with Client consent.
11. Charity Events
- Barbers may create charity events offering free haircut services through the Platform.
- Charity event bookings do not require deposits.
- The estimated value of charity services is tracked for potential tax deduction purposes. BarberClock does not provide tax advice; Barbers should consult a tax professional.
12. Privacy and Data
- BarberClock collects and processes personal data in accordance with our Privacy Policy.
- Location data is used to provide location-based services such as nearby barber search, in-home service coordination, and sales tax calculation.
- Barber location information is only shared with Clients on the day of a confirmed booking to protect Barber privacy.
- We use industry-standard security measures to protect your data, including encrypted communications and secure payment processing through Stripe.
13. Intellectual Property
All content, design, logos, and software associated with BarberClock are the property of BarberClock and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without prior written consent.
14. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Impersonate another person or entity.
- Submit false, misleading, or fraudulent information.
- Harass, abuse, or discriminate against any user.
- Attempt to gain unauthorized access to the Platform or other users' accounts.
- Use automated means (bots, scrapers) to access or collect data from the Platform.
- Circumvent or manipulate the Platform's booking, payment, or review systems.
15. Limitation of Liability
BarberClock provides a platform to connect Clients with Barbers. We do not employ Barbers and are not responsible for the quality, safety, or outcome of any service performed. To the maximum extent permitted by law:
- BarberClock is not liable for any direct, indirect, incidental, or consequential damages arising from use of the Platform.
- BarberClock is not responsible for disputes between Clients and Barbers or between Shop members.
- BarberClock does not guarantee the accuracy of Barber profiles, reviews, or availability.
16. Indemnification
You agree to indemnify and hold harmless BarberClock, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
17. Termination
BarberClock reserves the right to suspend or terminate your account at any time for violation of these Terms or for any conduct that we determine, in our sole discretion, to be harmful to the Platform or other users. You may delete your account at any time by contacting support.
18. Modifications to Terms
BarberClock may update these Terms from time to time. We will notify users of material changes through the Platform or via email. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
19. Dispute Resolution
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to participate in a class action lawsuit or class-wide arbitration.
20. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any legal action must be filed within one (1) year after the cause of action arises.
